The City desires to address the replacement of broken sidewalks within the city limits, and has established a sidewalk replacement program as set forth herein.
(a) The City has developed a plan and has systematically inspected each sidewalk within the City and tracked any sidewalk that is damaged and dangerous; and
(b) Part of this plan requires that property owners, who are ultimately responsible for their own sidewalks, replace any sidewalk that the City deems unsafe; and
(c) The City has the responsibility to oversee the construction and maintenance of said sidewalks and if requested, shall do the actual replacement and construction or shall contract out the replacement and construction; and
(d) If the City is requested by the property owner to perform, or to contract to perform the construction, the City has the right to assess said property owner for said construction; and
(e) The City of New Carlisle and/or its contractor shall enter said property in order to perform the sidewalk repair; and
(f) In the case that there are currently no sidewalks, the City shall have the authority to construct future sidewalks.
