The Fire Administrator may waive any of the provisions of the Ohio Fire Code and the National Fire Codes, as adopted in Section 1610.01, upon application therefor in writing by a property owner or lessee, or his or her duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the Codes, provided that the spirit of the Codes is observed, the public safety is served and substantial justice is done. The particulars of such a waiver, when granted or allowed, and the decision of the Administrator thereon shall be entered upon the records of the Division of Fire, and a signed copy thereof shall be furnished to the applicant.
