1460.99   VIOLATION AND PENALTIES.
   (a)   No person shall violate any provision or fail to conform to any of the requirements of this Exterior Property Maintenance Code or fail to comply with any order made thereunder.
   (b)   Whoever violates any section of this Code shall be guilty of a minor misdemeanor and upon conviction thereof, be fined not less than one hundred dollars ($100.00) but not more than one hundred fifty dollars ($150.00). Any person convicted of a second offense of this section within two years of the first offense shall be guilty of a misdemeanor of the fourth degree and, upon conviction thereof, shall be fined not less than one hundred fifty dollars ($150.00) but not more than two hundred fifty dollars ($250.00), or imprisoned not more than 30 days, or both. Any person convicted of a third offense of this section within three years of the first offense shall be guilty of a misdemeanor of the first degree and, upon conviction thereof, shall be fined not less than two hundred fifty dollars ($250.00) but not more than one thousand dollars ($1,000), or imprisoned not more than 180 days, or both. Any violation of any section of this Code is a strict liability offense.
   (c)   The application of the penalty provided in division (b) of this section shall not be held to prevent the enforced removal of prohibited conditions.
   (d)   Each day that a violation continues after due notice has been served as provided in this Code shall be deemed a separate offense.
