In exercising its duties, the Board of Appeals may, as long as such action is in conformity with this Zoning Code, reverse or affirm, wholly or partly, or modify, an order, requirement, decision or determination appealed from; may make such order, requirement, decision or determination as ought to be made; and to that end shall have the powers of the Zoning Inspector from whom the appeal is taken. The concurring vote of three members of the Board is necessary to reverse any order, requirement, decision or determination of the Inspector; to decide in favor of the applicant on any matter upon which it is required to pass under this Zoning Code; or to effect any variation in the application of this Zoning Code. For the purposes of this Zoning Code, the Board shall:
(a) Hear and decide an appeal where it is alleged that there is an error in any order, requirement, decision or determination made by the Zoning Inspector; and
(b) Authorize a variance from the provisions of this Zoning Code, with special conditions where necessary which are not contrary to the public interest, where, owing to the special conditions, a literal enforcement of this Zoning Code will result in unnecessary hardship, so that the spirit of this Zoning Code is observed and substantial justice done.
