(a) Amendments. Council may amend these Subdivision Regulations, following receipt of a formal recommendation from the Planning Board and following a public hearing with appropriate notice thereof. Council may also make such an amendment which is at variance with a recommendation of the Planning Board, provided such amendment is approved by at least five votes of the members of Council.
(b) Subdivider's Agreement. Council shall enter into a contract, called a sub-divider's agreement, with the subdivider or developer, specifying what public improvements are to be carried out and providing the legal basis for posting a performance bond.
(c) Release of Bonds.
(1) Performance bond. Council shall release the performance bond of the subdivider or developer as soon as the required public improvements have been accepted.
(2) Maintenance bond. Council shall release the maintenance bond of the subdivider or developer as soon as the stipulated time period has lapsed.
