§ 30.03 POLICY STATEMENT ON THE AMERICANS WITH DISABILITIES ACT.
   (A)   Policy statement.
      (1)   It is the policy of the town to provide equal access to all town-sponsored services, programs, and activities for citizens and employees with disabilities. Equal employment opportunity will be provided for all qualified individuals with a disability as defined by the Americans with Disabilities Act (ADA), being 42 U.S.C. §§ 12101 et seq.
      (2)   The town will make reasonable modifications in policies, practices, and procedures to ensure equal access; will make every reasonable effort to provide auxiliary aids and services to provide effective communication; and will operate its programs so that, when viewed as a whole, those programs are readily accessible to, and useable by, individuals with disabilities.

   (B)   ADA Coordinator. Jerry Cooper, Department of Public Works of the town is designated as the ADA Coordinator for the town.
   (C)   Administrative procedure.
      (1)   A town ADA Compliance Committee has been formed to assist in making reasonable accommodation decisions, provide a forum for reviewing grievances, and act as a source of information on ADA for the town.
      (2)   Questions concerning general ADA policy, reasonable accommodations, and grievances by citizens or employees not resolved by departments shall be directed to the ADA Coordinator for resolution. The ADA Coordinator shall resolve issues/grievances, convene the ADA Compliance Committee to hear appeals of citizen grievances, or simply make recommendations to departments or the Town Council as appropriate.
      (3)   In order to be qualified for a town position, an applicant must have the skills, experience, and knowledge as reflected by the essential functions of the position description with or without reasonable accommodation. Inquiries regarding preemployment or employment procedures, interviews, and hiring shall be directed to the ADA Coordinator for resolution. Department head/supervisor training will be conducted by the ADA Coordinator as required to ensure compliance with all aspects of Title I of the Americans with Disabilities Act.
      (4)   All departments are responsible for continually monitoring and evaluating current policies, procedures, facilities, and programs to achieve and maintain compliance with this directive and in turn the Americans with Disabilities Act (ADA).

   (D)   Americans with Disabilities Act grievance procedure. The Town of New Carlisle Grievance Procedure under the Americans with Disabilities Act, a copy of which is attached to Res. 18-05-08-01, is adopted as the grievance procedure for addressing complaints alleging discrimination on the basis of disability in the provision of services, activities, programs or benefits by the town.
   (E)   Notice.  
      (1)   The notice under the Americans with Disabilities Act, a copy of which is attached to Res. 18-05-08-01, is adopted as the Town of New Carlisle Notice under the Americans with Disabilities Act.
      (2)   In compliance with the Federal and state laws as set forth above, the Town Council resolves to post the required information regarding the ADA Coordinator, notice under the Americans with Disabilities Act, and the Town of New Carlisle Grievance Procedure under the Americans with Dsiabilities Act on its website and at such other locations as may be determined from time to time.
