((A) The Village Board shall determine:
(1) Whether the applicant has met the applicable state laws and village ordinances, including this section;
(2) Whether the applicant has complied with any operation plan or restoration plan; and
(3) Whether the health, safety, and public welfare of the inhabitants of the immediate area will be adequately protected, including the following factors:
(a) Effect on existing roads and traffic movement;
(b) Effect on surface drainage and the water supply;
(c) Soil erosion consideration;
(d) Effect of dust and noise in the vicinity;
(e) Feasibility of site restoration; and
(f) Effect on vicinity land values and uses.
(B) Upon an affirmative determination, the permit shall be issued.
