147.05 SICK LEAVE.
   (a)    Each full-time employee of the Village shall be entitled for each complete hour of service to sick leave of .0575 hours, a total of four and six-tenths hour for each eighty hours of service, excluding overtime. Each employee may use sick leave upon approval of the responsible administrative officer for absence due to personal illness, pregnancy, injury, exposure to contagious disease which could be communicated to other employees, and illness or death in the employee's immediate family, provided, however, that absence due to death or illness in the family shall be limited to three working days unless further absence is approved by the responsible administrative officer. Immediate family defined as only: spouse, parent or legal guardian, child or foster child, brother, sister, grandparent, grandchild, mother-in-law and father-in-law.

   (b)    Unused sick leave shall be cumulative without limit. When sick leave is used, it shall be deducted from the employee's credit on the basis of one hour for every one hour of absence from previously scheduled work.
   (c)    The responsible administrative officer shall require an employee to furnish a satisfactory written, signed statement to justify the use of sick leave. If medical attention is required, a certificate stating the nature of the illness from a licensed physician shall be required to justify the use of sick leave. Falsification of either a written signed statement, or a physician's certificate shall be grounds for disciplinary action, including dismissal.
   (d)    This section shall not be construed to interfere with existing unused sick leave credit where attendance records have been maintained and credit has been given employees for unused sick leave.
   (e)    A policy for payment of unused and accrued sick leave for all full-time employees of the Village, is hereby established as set forth in the following subsections:
      (1)    Any full-time employee of the Village upon retirement from employment after eight years of service with the Village and whose retirement shall become effective on or after February 4, 1975, shall be compensated for a part of unused and accrued sick leave credited to the employee at the time of such retirement from employment, such compensation to be in accordance with the following schedule of payment.
      (2)   Schedule of payment:
         A.   Hourly paid employees. Payment for hourly paid employees shall be determined by multiplying the hourly rate of pay, base plus accumulated longevity, by one-fourth of the accrued and unused sick leave credited to the employee up to a maximum payment for 250 hours accrued and unused sick leave or whichever is the lesser, one-fourth accumulated hours or 250 hours.
         B.   All salaried personnel except for Fire Department personnel. Payments for all salaried personnel, except Fire Department personnel, shall be determined by dividing the total annual salary, base plus accumulated longevity, by 2,080 hours to determine the hourly rate; multiply the hourly rate by eight to determine the turn rate; divide the unused and accrued sick leave credited to the employee by eight to determine the number of accumulated turns, whichever is the lesser, one-fourth of accumulated turns or thirty- one and one-fourth turns.
         C.   All Fire Department personnel. Payment for all salaried Fire Department personnel shall be determined by dividing the total annual salary, base plus accumulated longevity by 2080 hours to determine the hourly rate; multiply the hourly rate by twelve to determine the turn rate; divide the hours of unused and accrued sick leave by twelve to determine the number of turns; multiply the turn rate by one-fourth of the accumulated turns or up to a maximum payment of 20.83 turns, whichever is the lesser, one- fourth of accumulated turns or 20.83 turns.
         D.   Payment of unused and accrued sick leave on this basis shall be considered to eliminate all accrued and unused sick leave credited to the employee at the time of payment.
   (f)   Upon written notice of retirement from employment certified as to effective date by the chief administrative officer of the Village, the Clerk shall, within ninety days of the effective date, determine the amount of payment according to the schedule and shall forward the payment to the employee, payment to be made from funds duly appropriated and set aside for such payment by Council.
