331.45 OPERATION OF LOW SPEED, UNDER SPEED OR UTILITY VEHICLES.
   (a)   No person shall operate a low-speed or under-speed vehicle upon any street or highway except upon a street or highway having an established speed limit not greater than twenty-five miles per hour. This section does not prohibit the following:
      (1)   A person operating a low-speed or under-speed vehicle from proceeding across an intersection of a street or highway having a speed limit greater than twenty-five miles per hour.
   (b)   No person shall operate a low-speed or under-speed vehicle upon any street or highway without a valid driver’s license and proof of financial responsibility in amounts equal to the requirements under Ohio Revised Code 4509.01.
   (c)   All sections of the Traffic Code or substantially similar offenses shall apply to low-speed or under-speed vehicles operated upon any street, highway or private property used for vehicular travel.
   (d)   The owner of a low-speed or under-speed vehicle who wishes to operate on a public street or highway must first submit the vehicle to a three year inspection at a cost of twenty-five dollars ($25.00) and which complies with the requirements established by the Ohio Department of Public Safety under Section 4513.02 of the Ohio Revised Code, including but not limited to the following:
      (1)   Adequate brakes and braking system;
      (2)   Properly working brake lights, head lights, taillights, and turn signals;
      (3)   A property working steering mechanism;
      (4)   A working horn and warning devices, audible from not less than 200 feet;
      (5)   A windshield and operational windshield wipers;
      (6)   A rearview mirror;
      (7)   Exhaust system, tires and such other equipment as designated by the superintendent of the state highway patrol by rule or regulation in Sections 119.01 to 119.10 of the Ohio Revised Code; and
      (8)   Seat safety belts must be installed at each designated seating position and shall be part of the safety inspection.
   (e)   Low-speed or under-speed vehicles operated on public streets or highways must successfully pass the required vehicle inspection and display an inspection sticker that will be issued at the time of passing the inspection. Said inspection sticker shall be printed on a different color sticker each year.
   (f)   Following inspection, the low-speed or under-speed vehicle shall be maintained in compliance with all equipment set forth in division (d).
   (g)   Low-speed or under-speed vehicles must be registered in accordance with Chapter 4503 of the Ohio Revised Code and must be titled in accordance with Chapter 4505 of the Ohio Revised Code.
   (h)   Whoever violates this section is guilty of a minor misdemeanor on a first offense. If the offender has previously been convicted of a violation of the section, the violator is guilty of a misdemeanor of the fourth degree. Nothing in the section shall limit the Village from filing other violations of law including but not limited license violations.
