1101.03 DEFINITIONS.
   (a)   For the purpose of these Regulations, the following words and phrases shall have the meanings respectively ascribed to them:
      (1)   "Alley" means a minor way which is used primarily for vehicular service access to the back or side of properties otherwise abutting on a street. An alley is a public way, dedicated, platted and recorded with the recording of the final plan of a subdivision.
      (2)   "Convey" means to make a conveyance of property.
      (3)   "Conveyance" means the act of making a transfer by conveyance of right, title, interest and/ or ownership to property.
      (4)   "Dead end" means a short street having one end open to traffic and being permanently terminated at the other end.
      (5)   "Develop" means to make a development; also to do any grading or filling of land, whether undeveloped or already subdivided, so as to change the drainage or the flow of water, or to do any work upon the land that is capable of future use as a subdivision or development of building sites.
      (6)   "Development" means the subdivision of land; also any work that must be performed such as an improvement prerequisite to approval of final plat and construction upon the land.
      (7)   "Divide" means to make a subdivision.
      (8)   "Division" means a subdivision.
      (9)   "Easement" means a grant by the property owner of the use of land by the public, a corporation of persons for specific purpose.
      (10)   "Engineer" means a registered engineer; a person authorized to practice civil engineering as defined in Ohio R. C. Chapter 4733.
      (11)   "Improvements" mean street grading, street pavements or surfaces, curbs, gutters, sidewalks, storm sewers, culverts, sanitary sewers, water mains, cross walkways, street trees and other appropriate items.
      (12)   "Land" means a tract or group of tracts.
      (13)   "Lease" means to rent or to permit the possession or use of right of possession or use for consideration, of a lot, parcel, tract, land or group of lots, parcels, tracts, or lands.
      (14)   "Lot" means a portion of a subdivision or other parcel of land intended as a unit of transfer of ownership or for development. Such lot need not be a part of a recorded subdivision.
      (15)   "Parcel" means an ownership, lot plat, or part of an ownership, lot or plat.
      (16)   "Partition" means a division, separation or subdivision; the act of making a division, separation or subdivision.
      (17)   "Performance bond" or "surety bond" means a personal or corporate surety agreement between a subdivider and such surety in favor of a governmental body guaranteeing the completion of physical improvements according to plan and specifications within the time prescribed by the subdivider's agreement.
      (18)   "Person" means any individual, group of persons, association, firm, corporation, developer or any proprietor of lots or grounds.
      (19)   "Planning Commission" means the Municipal Planning Commission.
      (20)   "Plan" means a plan, made and adopted under Ohio R. C. Chapter 711 including the general locations recommended for the major streets, parks, or public space.
      (21)   "Plat" means a lot or parcel.
      (22)   "Plat, final" means the finalplat of a subdivision. An accurate drawing, to a scale indicated on the drawing, of a subdivision showing the location and boundaries of the tract, or group of parcels of land, together with the location and description of lots, streets, alleys, easements, public grounds, grades or contours, north point and other information and submitted to the appropriate commission upon the completion of the acts required by these regulations.
      (23)   "Preliminary plat" means a preliminary drawing, or sketch, of a proposed subdivision, showing the location and boundaries of a tract or group of parcels of land, together with the general location of streets, alleys, easements, lots, public grounds, north point, grades or contours, drainage provisions, and names of the subdivision of the streets and of adjacent properties.
      (24)   "Resubdivision" means rearrangement and subdivision of a tract comprising a group of lots, parcels, streets, alleys, or any combination of lots, parcels, streets and/or alleys.
      (25)   "Right of way" means the width between property lines of a street, parkway, alley, crossway or easement.
      (26)   "Sale" means the act of selling.
      (27)   "Sell" means to make a conveyance for considerations or for a price; to execute a deed for sale; to execute a sales contract.
      (28)   "Separate" means to make a separation.
      (29)   "Separation" means the partitioning or division of a lot, parcel, tract, land or subdivision thereof, into two or more parcels of land.
      (30)   "Setback line, building" means a line indicating the minimum distance between the street easement or right of way line and buildings or any projection thereof other than steps or permanently open porches, unless otherwise specifically defined.
      (31)   "Street" means a right of way, dedicated to public use, which provides vehicular and pedestrian access to adjacent properties other than arterial or collector and local streets. Below are listed various street types within the scope of these Regulations:
         A.   "Arterial" means those streets which are used primarily for fast and heavy traffic. These are streets of considerable continuity which serve or are intended to serve as major traffic ways within the Municipality, County, or both. Those streets comprising the basic structure of the street or road plan.
         B.   "Collector" means a street or quarter section line road of considerable continuity which serves or is intended to serve as the principal traffic way between large and separate areas or districts and which is the main means of access to the primary road system. These streets carry traffic from minor streets to the major system.
         C.   "Local" or "Minor" means a street which is used primarily for access to abutting properties. It is of limited continuity and is intended to serve the local needs of a. neighborhood.
         D.   "Service roads" means minor streets which are parallel to and adjacent to primary streets and highways; and which provide access to abutting properties and protection from through traffic.
      (32)   "Street width" means the shortest distance between the lines which delineate the right of way of a street.
      (33)   "Subdivision" means:
         A.   The division of any parcel of land shown as a unit or as contiguous units on the last preceding tax roll, into two or more parcels, sites, or lots, any one of which is less than five acres, for the purpose, whether immediate or in the future, of transfer of ownership, provided, however, that the division or partition of land into parcels of more than five acres shall be exempted when new streets or easements of access are not involved, and the sale or exchange does not create additional building sites; or
         B.   The improvement of one or more parcels of land for residential, commercial or industrial structures involving the division or allocation of land for the opening, widening, or extension of any street or streets, except private streets serving industrial structures; the division or allocation of land as open spaces for common use by owners, occupants or lease holders or as easements for the extension and maintenance of public sewer, water, storm drainage or other public facilities.
      (34)   "Thoroughfare Plan" means the system of arterial and collector thoroughfares and ways as adopted by the Planning Commission.
      (35)   "Tract" means an ownership, lot, plot or group of ownerships or lots.
      (36)   "Transfer" means to sell or lease by the process of subdivision as defined herein or the act of making such a sale or lease.
