(a) The contract executed by the Village pursuant to this chapter shall grant to the Company the nonexclusive right and privilege to erect, construct, operate and maintain in, upon, along, across above, over and under the highways, sidewalks, easements, dedications and other public property now in existence and as may be created or established during its terms; any poles, wires, cable, underground conduits, manholes and other television conductors and fixtures necessary for the maintenance and operation of a cable system for the interception, sale, transmission and distribution of television programs and other audio visual and data carrying electrical signals and the right to transmit the same to the inhabitants of the Village on the terms and conditions hereinafter set forth.
(b) However, all construction must be approved in advance by the Village Administrator. No construction may commence until a permit has been issued by the Administrator to construct within the right of way or easement.
(c) The Village Administrator shall designate which Village-owned poles must be upgraded prior to construction, such upgrading to be at Company's expense. The Administrator shall also designate which areas are to be constructed aerially and which shall be underground.
