(a) No person, being the owner or occupant of any lot or land within the Municipality, shall make any cellar or other excavation therein, without walling or guarding such excavation that it shall not become a pond of stagnant water, or cause or permit water to remain and become stagnant upon such lot. (b) Lot owners of the Municipality shall fill and drain their lots in such manner as shall be necessary to remove all stagnant water. Removal of such water shall be effected in such manner as to prevent the recurrence of stagnant water.
(c) In case the owner of any lot in the Municipality fails or refuses to comply with the provisions of subsection (b) hereof, the work required thereby shall be done by the Municipality, and the expense for same shall be assessed against such owner.

(d) Whoever violates this section is guilty of a minor misdemeanor.
