(A) The Newberry County Council, as the governing body of Newberry County, hereby appoints and commissions the following county employees as Code Enforcement Officers and shall appoint additional Code Enforcement Officers from time to time as may be necessary for the proper security, general welfare, and convenience of the county, as provided by S.C. Code § 4-9-145, as amended.
(1) Zoning Administrator, and any deputy or employees in that office;
(2) Building Official, and any deputy in that office;
(3) All building inspectors;
(4) Flood Plain Manager;
(5) Animal Shelter Operations Manager;
(6) All employees in the Animal Control Department.
(B) Each of them may enforce any county ordinance the violation of which he or she observes by issuing an ordinance summons on the county-prescribed ordinance summons form requiring the appearance in Magistrate's Court of the alleged violator to anser the charges made against such person. No Code Enforcement Officer may accept the payment of bond from any defendant, nor shall such person make a custodial arrest.
(C) Such persons, who are not duly commissioned by the state as law enforcement officers shall take an oath in the form prescribed by Article VI, § 5 of the South Carolina Constitution before entering into their duties and the Clerk of Council shall maintain a record of these oaths in his or her office.
(D) The County Administrator will, with the assistance of other county officials, set up a program for the instruction of these persons in the legal requirements of issuing ordinance summons to alleged violators, and in the requesting of bonds and setting of cases for trial, and in the presentation of case to the Magistrate's Court, and will endeavor to ensure that all designated Code Enforcement Officers are familiar with their duties, rights and obligations in this area.
