(A) The Newberry County Administrator is authorized to accept the custody, care, and control of those prisoners that the Sheriff of Newberry County shall make available to him or her for use on the public works of Newberry County, including maintaining county buildings, maintaining county roads and bridges, animal control and litter control on the public highways in Newberry County, and other similar public works.
(B) The County Administrator, or the department head as he or she shall designate, shall be responsible for assigning duties to the prisoners, supervising their work activities, and assuring that the public is adequately protected from the risk of prisoners escaping from the bounds of their confinement; further, the County Administrator shall assign and utilize the prisoners only in accordance with the rules and regulations established by the South Carolina Department of Corrections.
(C) Pursuant to the Litter Control Act of 1978, codified as S.C. Code § 44-67-10, the Newberry County Administrator is authorized and empowered to contract with the South Carolina Department of Health and Environmental Control (DHEC) for the use of prisoners for litter removal along public roads, and other appropriate areas authorized by law, in accordance with regulations of the South Carolina Department of Corrections and DHEC.
(D) Pursuant to S.C. Code § 24-3-30, the Newberry County Administrator, upon approval by the Newberry County Council, is authorized to negotiate with and enter into contracts with the municipal authorities of any city or town within the County of Newberry for the use on the highways, streets, and other public works of any such municipality of inmates incarcerated in the Newberry County Jail, and which are made available for the purposes by the Newberry County Sheriff. Any such agreement with a city or town shall contain adequate provisions for the proper supervision, utilization, care, and control of the inmates, in accordance with the laws and regulations of the State of South Carolina.
(E) In the event that the Newberry County Council enters into an agreement with the Sheriff of Newberry County, pursuant to S.C. Code § 24-5-12, whereby the powers and duties relating to the custody of the County Jail are devolved on to the Newberry County Council, then the Newberry County Administrator shall take all of the actions provided by this section, without the necessity of the approval of the Newberry County Sheriff.
(F) Pursuant to the provisions of S.C. Code § 24-3-20(C), Newberry County Council hereby approves the use of the prisoners confined at the county jail, who are serving a sentence of 90 days or less, in the performing of litter removal functions within the county. The Newberry County Administrator is hereby authorized to utilize the prisoners for the litter removal function, to appoint persons to supervise their use, to properly transport, clothe, and feed the prisoners while so utilized, and any prisoners who perform the litter removal function shall be entitled to a 1-day reduction of their sentence for each 2 days of litter removal work performed
