§ 150.04 PERMITTEE'S RESPONSIBILITY.
   (A)   The permittee shall indemnify and save harmless the County of Newberry, its officers, agents, and employees from all suits or claims of any character brought because of any injuries or damages received or sustained by any person or property on account of the operations of the permittee or on account of or in consequence of any neglect in safeguarding the work or through use of unacceptable materials and workmanship in constructing the work or because of any act or omission, neglect, or misconduct of the permittee or because of any claims or amounts paid for any reason.
   (B)   As required by S.C. Code § 57-7-60, the County Administrator, or his or her designee, may require the execution of and depositing of in the office of the County Administrator a good and sufficient bond of indemnity, or cash, in the sum as may be required to repair the road or right-of-way and restore it to as good condition as to foundation and surface as it was before being excavated. When the excavation is to be made by a solvent public utility, the bond may be executed by the utility without additional surety.
