For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DANCER. An employee of a sexually-oriented business who entertains patrons through expressive forms of dance and/or movement.
EMPLOYEE. An individual working and performing services for any sexually-oriented business, including any independent contractor who provides services on behalf of any sexually-oriented business to the patrons of the business.
LIVE ENTERTAINMENT. A person who appears nude, semi-nude, or a performance which is characterized by the exposure of specified anatomical areas or specified sexual activities.
NUDITY or STATE OF NUDITY. The appearance of a bare human buttocks, male genitals, female genitals, or female breast(s) or the use of opaque material that gives of the appearance of less than completely or opaquely covered human buttocks, male genitals, female genitals, or female breast(s).
SEMI-NUDITY or STATE OF SEMI-NUDITY. A state of dress in which clothing, or opaque material that gives the appearance of less than completely or opaquely covered human buttocks, male genitals, female genitals, or female breast(s), covers no more than the genitals, pubic region, areolae of the female breast, and those portions of the body covered by supporting straps and devices.
SPECIFIED ANATOMICAL AREAS.
(1) Less than completely and opaquely covered human genitals, pubic region, buttocks, anus, or female breast areolae; or
(2) Human male genitals in a discernibly turgid state even if completely and opaquely covered.
SPECIFIED SEXUAL ACTIVITIES.
(1) The fondling or other erotic touching of human genitals, pubic region, buttocks, anus, or female breast;
(2) Sex acts, normal or perverted, actual or stimulated, including intercourse, oral copulation, or sodomy;
(3) Masturbation, actual or simulated;
(4) Human genitals in a state of sexual stimulation or arousal;
(5) The fondling, erotic touching, or other such contact with an animal by a human being; or
(6) Excretory functions as a part of or in connection with any of the activities set forth in divisions (1) through (5) above.
