(A) Warnings. In the case that Newberry County Animal Care and Control notices, or is informed of, a condition that may violate this chapter, it may, but is not required to, first issue a warning to the suspected offender, and give that person a reasonable period of time in which to address the problem noted.
(B) Citations under ordinance summons procedure. In the case of welfare checks, it will be left to the discretion of the Newberry County Animal Control Officer responding whether probable cause exists to either issue a citation to the owner concerning the offenses committed, or to impound the animal. If a citation is issued under the Newberry County Ordinance Summons procedures, the owner will have a limited time period assigned to them to improve conditions and/or correct the offense. If the problem is not corrected before the court date, Newberry County Animal Care and Control is authorized to take further action to impound the animal, including seeking a Court Order for impoundment. If it is determined that the animal continues to be in danger, and the owner may be prosecuted again for animal neglect, ill-treatment, or animal cruelty if the offense if not abated.
