(A) Owned animals found at large are subject to impoundment, if:
(1) The animal does not have a rabies tag.
(2) It is a dangerous animal.
(3) The animal is engaging in behavior that poses a threat to children, to handicapped persons or to elderly persons in the vicinity.
(B) Owned dogs of the type normally used for the type of hunting then in season, and which are found at large on the owners' property or property where the owner has a right to be, are not subject to impoundment, if they are engaged in hunting activities. Any such animals which are impounded shall be promptly released to the owner for no fee.
