(A) The seal attached to Ordinance 03-09-04 as Exhibit “A” is adopted as the design of the official seal of Newberry County, for use when a multi-colored seal is displayed on county vehicles and other equipment, on county banners, on the county internet website, on county-issued identification cards, on county stationery for the various departments of the county, and the like. The size of the seal used may vary with the application, as is appropriate.
(B) The seal attached to Ordinance 03-09-04 as Exhibit “B” is adopted for use as the design of the official seal for use when a multi-colored seal is not appropriate, and may be used on county stationery for the various departments of the county and on county applications and permits and official notices, on county-issued identification cards or badges, and the like, when a monochrome color scheme is required or desired. The size of the seal used may vary with the application, as is appropriate.
(C) The impressed seal on the sheet attached to Ordinance 03-09-04 as Exhibit “C” is the official seal to be used on all official documents executed by the County Administrator or the Chairperson of County Council, or attested by the Clerk to Council, or otherwise executed by authorized officials of Newberry County acting at the direction of, or under the authority granted by, Newberry County Council.
(D) The official motto of Newberry County is “Pro Bono Publico,” which is Latin for the phrase “For the Public Good,” and is indicative of the goal of Newberry County government to act in a manner that serves the best interests of its citizens.
(E) The official county seals shall only be used when duly authorized by the County Council, the County Administrator, or the elected or appointed head of a county department or agency.
(F) Any person who shall use the official county seals, or any of them, or the county motto, to impersonate a county official or employee, or for a commercial advantage, or otherwise without proper authorization as specified herein, shall be guilty of a misdemeanor, and shall be subject to being punished to the maximum extent of the law for those violations that are enforceable in the jurisdiction of the magistrate's courts of this state. Violators may also be cited by summons issued under the ordinance summons provisions heretofore adopted by Newberry County Council. The county may also seek injunctive and other relief in the civil courts against persons who use the official seals, or either of them, or the county motto, in a manner that has not been duly authorized.
