In the event the solid waste transfer station of the county is not approved for the receipt of waste requiring special treatment or which is considered hazardous waste under state or federal regulations, or which otherwise cannot be lawfully disposed of in the landfill operated by the private contractor which disposes of the waste delivered to the solid waste transfer station, the county and its contractor will refuse any waste which is improperly delivered to the solid waste transfer station, and county officials are authorized to pursue any necessary remedy at law or equity, including recovery of any costs incurred in disposing of the special, hazardous, or otherwise improper waste materials, and/or seeking injunctive relief. The county is authorized to seek and collect attorney fees from those persons who deliver or cause to be delivered to the solid waste transfer station special, hazardous, or other waste which cannot be lawfully disposed of at the solid waste transfer station.
