§ 138.06 POSSESSION OF MARIJUANA.
   (A)   No person shall knowingly obtain, possess or use marijuana.
   (B)   Any person convicted of violating this section shall be sentenced to not more than 30 days in jail and fined not more than $250, or both, unless the amount of marijuana involved is less than 100 grams; the amount of marijuana resin, or extraction or preparation of such resin, is less than five grams; and the amount of such resin in a liquid concentrate, liquid extract or liquid distillate form is less than one gram, in which case, upon conviction, shall be fined not more than $100.
   (C)   In the event arrest or conviction is for the lessor offense, violation does not constitute a criminal record and need not be reported by the person so arrested or convicted in response to any inquiries about the person’s criminal record, including any inquiries contained in any applications for employment, license or other right or privilege or made in connection with the person’s appearance as a witness.
