3-1-7: WATERCOURSES MAINTAINED, KEPT OPEN:
   A.   All watercourses within the city limits shall be maintained and kept open in their original course where the water naturally flows, and any person changing or altering the course of any watercourse without permission of the city council shall be deemed guilty of a nuisance and upon conviction thereof shall be fined in a sum not exceeding five hundred dollars ($500.00).
   B.   When any watercourse has been heretofore changed, altered or obstructed by any person so as to deflect the water from its original and natural course, without the permission of the city council, or when any watercourse shall hereafter be so changed, altered or obstructed without the permission of the city council, the marshal of the city shall, when so ordered by the city council, give the person who has so changed, altered or obstructed such watercourse, or who may hereafter change, alter or obstruct the same, and also the person upon whose land the change, alteration or obstruction has been or is made or placed, ten (10) days' notice to remove the same so as to let the water flowing through such watercourse flow in its original and natural course, and upon a failure of such person to remove such obstructions within ten (10) days after receiving such notice, he shall be deemed guilty of a nuisance and upon conviction thereof shall be fined a sum not to exceed five hundred dollars ($500.00).
   C.   When any person has heretofore or shall hereafter place or maintain any obstruction in any watercourse within the city so as to deflect the water from its natural course into the streets or alleys of the city and which injures said streets or cuts or washes the same, the city marshal shall, upon the order of the city council, notify the person who so placed or who so maintains such obstruction in such watercourse, to remove the same within ten (10) days from the service of such notice, and unless it is removed within ten (10) days after such notice, the person who so placed or so maintains such obstruction in any such watercourse shall be deemed guilty of a nuisance and shall, upon conviction thereof, be fined in a sum not to exceed twenty five dollars ($25.00) for every day he shall so maintain such obstruction or fails to remove the same after the expiration of the time given by such notice.
