3-1-6: FOOTPATHS AND PEDESTRIANWAYS:
   A.   It shall be lawful for any person owning real estate within the city, himself or by his agent, to place and maintain posts for the protection of certain parts of streets for footpaths or sidewalks for pedestrians along their respective premises, by first obtaining permission so to do from the city council in the following manner:
      1.   Any person wishing to place posts on any public street of the city for the purpose set forth herein shall make application to the city council for such permit, said application to give a description of the premises and street where it is desired to place such posts. The city council shall have the right to grant or not to grant such permit, at its discretion.
      2.   All posts placed in the city for the purpose herein set forth shall extend not less than four feet (4') aboveground, shall be painted white or whitewashed, and shall be seven feet (7') from the line of such premises, except on Main Street, where they may be ten feet (10') from the line of such premises.    B.   Any person who shall, after the taking effect of this section, maintain or fail to remove any such post previously erected along his premises, within ten (10) days after being notified to remove the same by the marshal acting under order of the city council; and any person who shall hereafter place any such post on any street in the city in violation of this section shall be deemed guilty of a nuisance and shall, upon conviction thereof, be fined as provided in section 1-4-1 of this code.    C.   Sidewalks in the city of Nauvoo shall be constructed according to guidelines for construction of sidewalks as published by the city council. At a minimum, all sidewalks will be of concrete using a 6-bag mix and shall be four feet (4') in width or match existing adjacent sidewalk for the purpose of uniformity and four inches (4") thick. The sidewalk should not be closer than eight feet (8') to any tree roots or other plant or object that could cause the sidewalk to become uneven. (Ord. 2004-12, 1-11-2005)
