Should any section, clause or provision of these Rules and Procedures or any amendment thereto be declared by the courts to be invalid, the same shall not affect the validity of such Rules and Procedures or amendment as a whole, or any part thereof, other than the section, clause or provision so declared to be invalid.
Should any section, clause or provision of these Rules and Procedures or any amendment thereto be in conflict with any collective bargaining agreement, covering a bargaining unit employee who is also a civil service employee, that is in force at the time the conflict arises, the collective bargaining agreement shall be controlling and prevail, unless the bargaining unit employee is expressly permitted by contract to elect these Rules and Procedures over the agreement and does in fact so make such an election, in writing to the commission, in a timely manner.
It is the intent of this commission that the term "Rules" and the term "Procedures" be synonymous.
