195.01 DEFINITION OF TERMS.
Rule 1.1   Definitions
"ALLOCATION" means the assignment of a class to a pay range or an appropriate pay level.
"APPLICANT" means a person that has formally applied for a position with the city.
"APPOINTMENT" means the act of selecting and hiring an individual to a position in the employment of the city.
"APPOINTING AUTHORITY" means the officer, board, body, or commission who, pursuant to the charter of the City of Napoleon, ordinance, or resolution thereof, has the power of appointment, dismissal, transfer, demotion, suspension or promotion of any officer or employee of the city.
"AUTHORIZED POSITION" means the position set forth in the official city chart of organization which has been authorized and approved by city council.
"BUSINESS DAYS" means any day the City, office of administration, is open for regular business.
"CERTIFICATION" means the act by which the Civil Service Commission sends to the appointing authority a list of names and applicants eligible for a specific position.
"CIVIL SERVICE" for purposes of these rules refers to and includes all offices and positions of employment and trust in the service of the City, who are otherwise not excluded therefrom. (Except as otherwise provided herein, to the extent permitted by law, exempt from the service of the City Civil Service Commission are the City Health District and employees thereof, if any, and the City School District and employees thereof. Such services may only be acquired through a contract between the entity desiring the service and the city, when so approved by council.)
"CITY" is the City of Napoleon, Ohio.
"CLASSIFIED SERVICE" means all positions set forth in Chapter 155 of the Codified Ordinances of the City of Napoleon, Ohio as may be amended from time to time, as being in the Classified Service.
"COMMISSION" means the Municipal Civil Service Commission of the City.
"CONTINUOUS SERVICE" means the time a person has been continuously employed with the city, including time served as a full-time, permanent part-time, part-time, temporary, provisional or probationary employee where there has been a continuation of employment to permanent status without any break in service.
"DEMOTION" means a reduction from one class to another class for which the maximum rate of pay is lower.
"DISMISSAL" means the permanent involuntary separation of an employee from city employment, except for layoff.
"ELIGIBLE" means a person that has formally applied for a position with the city and has been placed on an eligibility list, or that has qualified to be placed on an eligible list.
"ELIGIBLE LIST" means a list of names established either through registration, examination or reinstatement for the purpose of filling vacancies in the classified service.
"EMPLOYEE". Unless the context otherwise indicates, employee shall mean any employee of the City.
"EXAMINATION" or "TEST" means methods or procedures used by the city to assess the relative capability of applicants to perform the duties and responsibilities of the position sought.
"FULL-TIME" means (employee) full-time regular as defined in the city's personnel code and as may be amended from time to time. “FULL-TIME” also means, when the context is clearly defining a position other than with the City of Napoleon, being employed in a position being either salary or having a regular work week of at least thirty-five (35) hours.
"HE" The masculine pronoun and its derivatives, whenever employed, include the feminine pronoun and its derivatives.
"JOB SPECIFICATION" means job description, a written summary of the duties and responsibilities of a position.
"LAYOFF" means removal of an employee from city employment due to the lack of work, lack of funds, or to changes in administrative organization abolishing one or more positions.
"ORDER" means a disciplinary action or measure issued to a classified employee by the appointing authority.
"PART-TIME" means any employee of the part-time status which includes (employee) part-time, (employee) permanent part-time, (employee) temporary, all as defined in the city's personnel code and as may be amended from time to time.
"PAY RANGE" means a group of standard rates of pay as set forth in city legislation.
"POSITION" when used by itself means any specific office, employment or job calling for the performance of certain duties, either full-time or part-time and for the exercise of certain responsibilities by one (1) individual.
"POSITION CLASSIFICATION" means the arrangement of positions into classes, including grades, classified by the duties and responsibilities of the positions.
"PROMOTION" means advancement of an employee from one (1) position if a class to another higher position in the same class for which the maximum rate of pay is higher.
“SERVICE IN THE UNIFORMED SERVICES” has the same meaning as in the “Uniformed Services Employment and Reemployment Rights Act of 1994", 108 Stat. 3149, 38 U.S.C.A. 4303.
 
"STEP INCREASE" means an increase in pay from one (1) pay step to the next successive pay step within a pay range.
 
"SUSPENSION" means the temporary and involuntary separation of an employee from city employment for disciplinary purposes.
 
“TEMPORARY APPOINTMENT” means an appointment of a person who may work a time or in excess of the time that is required to meet full time employee status, but is hired for a period of time expected to be less than eight (8) months or no later than on completion of a specific assignment is considered a temporary employee.
 
"UNCLASSIFIED SERVICE" means all positions set forth in Chapter 155 of the Codified Ordinances of the City as amended from time to time, as being in the Unclassified Service.
 
“UNIFORMED SERVICES” has the same meaning as in the “Uniformed Services Employment and Reemployment Rights Act of 1994", 108 Stat., 3149, 38 U.S.C.A. 4303.
 
"WORKING DAY" means any day during which the employee is regularly scheduled to work or the days during which the municipal offices are open for business, (generally Monday through Friday; however, schedules may be different, e.g., in the police and fire departments), whichever is applicable.
