177.02 MEETINGS/HEARINGS AND RULES.
   The Board of Building Appeals is hereby authorized to promulgate rules and regulations governing its meetings or hearings. All meetings and hearings shall be governed by the minimum rules contained in this section or the specific code that is the subject of the hearing or appeal. Where there exists rules regarding the Board activities as they relate to a specific code, those rules, as may be amended or repealed from time to time, shall control. Any additional rules that the Board may adopt shall be adopted by resolution of the Board. For passage of the Board resolutions, such resolutions shall require only one reading prior to passage and an affirmative vote by a majority of all current members. After passage, the resolutions shall be signed by the Board Chairman or Acting Chairman, who is selected by the Board, and need not be published, but shall be filed in the office of the Finance Director, or in the case when a specific Council Clerk exists, then in the office of the Council Clerk.
   (a)   All meetings or hearings of the Board shall be held at the call of the Chairman of the Board and at such other times as the Board may determine. The Chairman or Finance Director, or in the case when a specific Council Clerk exists, then such Clerk, shall notify all members of the Board in advance of all meetings and hearings, of their time and place. No meeting, hearing or action may be taken unless a quorum is present: a majority of all current members of the Board constitutes a quorum.
   (b)   Decisions and recommendations of the Board shall be reached only after a meeting or when required, a hearing, and after due notice of all meetings and hearings has been given to the person requesting the hearing or appeal and the City by and through its Code Official; such notice may be satisfied by publication when not otherwise required by other means.
   (c)   All Meetings or hearings shall be open to the public, except as may otherwise be permitted by law.
   (d)   All evidence and testimony submitted to the Board shall be publicly presented, except as may otherwise be permitted by law.
   (e)   The Chairman, or in the Chairman's absence, the Acting Chairman, may administer oaths and compel attendance of witnesses. In the absence of the Chairman, the Acting Chairman may do all other things associated with the duties of the Chairman.
   (f)   The Finance Director, or in the case when a specific Council Clerk exists, then such Clerk, shall keep a record of the proceedings of the Board, showing the vote of each member on every question.
   (g)   No hearing shall be conducted without a quorum of the Board being present; a quorum shall consist of a majority of all current members.
