(a) Establishment of Board. There shall be a Board of Building Appeals consisting of five members, each of whom shall be a resident and qualified elector of the City, appointed by the Mayor and approved by Council: one for a term of one year, two for a term of two years, and two for a term of three years. Each year thereafter, the Mayor shall appoint one or more persons (as the case may be), as successors of the members whose terms expire, to serve a term of three years, subject to approval by Council. Any vacancy shall be filled for the unexpired term. The Mayor, at any time, may remove any member from office for misconduct, neglect of duty, malfeasance in office, or other cause, subject to approval by Council. Board members shall serve without compensation, except as may otherwise be provided by Council.
(b) Powers and Duties. The Board of Building Appeals shall have those powers and perform those duties as Council may provide by ordinance or resolution and more specifically, the following:
(1) To hear an appeal filed by any person adversely affected by a decision, order or determination of the Zoning Administrator, Building Inspector, Sign Code Administrator, or other such code official, relative to the application of Building Codes, Sign Codes, and the B.O.C.A. National Property Maintenance Code.
(2) To formulate and report to the appropriate governing body from time to time recommendations for action by them upon such amendments to the Building Codes as the public health, safety, and the development of arts and sciences may require.
