955.02 DEFINITIONS.
   As used in this chapter, the following words and phrases shall have the meanings set forth herein.
   (a)   “Adult” means a person 18 years of age or more.
   (b)   “Child” means a person under 18 years of age.
   (c)   “City” means the City of Napoleon, Ohio.
   (d)   “City recreation facilities” shall include, but are not necessarily limited to, all municipal parks, athletic fields, municipal golf courses, municipal swimming pools, municipal tennis courts, municipal ball diamonds, municipal volley ball courts, municipal soccer fields, municipal skating areas, and other similar type facilities (including the premises and its structures and appurtenances thereon) owned or leased by the City.
   (e)   “City recreational program” means a program or activity designed to promote health or means of refreshment and diversion to persons and specifically adopted by City legislation as being a City recreational program or activity and meeting the written approval of the City’s liability carrier; or, a program or activity designed to promote health or means of refreshment and diversion to persons and meeting all the following criteria:
      (1)   The entity is one hundred percent (100%) owned by the City.
      (2)   The entity is one hundred percent (100%) controlled by the City. This includes absolute control of ways, means, and methods of operation, personnel, policy and procedure.
      (3)   The City is one hundred percent (100%) financially responsible for the entity. In addition, the City maintains the financial records and pays or authorizes payment of all obligations.
      (4)   The City appoints all officials unless they are elected by City residents.
      (5)   The City has the exclusive power to hire, fire, discipline, and otherwise supervise all employees and volunteers of the entity.
   (f)   “Domicile” means the legal home of a person, located in the place where the person is eligible to vote.
   (g)   “Immediate family” means spouse, child, or stepchild living in the same residence, including those who have graduated from high school during the current year and full-time students of higher education.
   (h)   “Junior” means a person enrolled in school up to and including the eighth grade; also includes a person through the summer period following completion of the eighth grade.
   (i)   “Non-resident” means anyone who is not a resident as defined in this chapter.
   (j)   “Resident” means a person living in the corporate limits of the City or a payer of City income tax. (For the purpose of this definition, a payer of City income tax will mean one who currently pays the full established rate of City income tax or paid the full established rate of City income tax within the preceding twelve-month period (unless the payer was exempted due to an alternate City tax policy of the City); one living within the corporate limits will mean one who has the City as his or her place of domicile; further, when a child is a participant, the consideration of being a resident or non-resident shall be determined by the status of the parent or legal guardian of the participant that pays any applicable participation or activity fee.
   (k)   “Senior citizen” means a person of 60 years of age or more at time of purchase of privilege(s) and admission card(s).
   (l)   “Step child” means child.
   (m)   “Student” means a person enrolled in elementary school, middle school, or high school through the twelfth grade; also includes children that are “home schooled” that would otherwise have met the criteria just previously stated; also includes a person through the summer period immediately following graduation from the twelfth grade.
   (n)    “Weekdays” means Monday through Friday.
   (o)    “Weekends” means Saturday and Sunday.  (Ord. 090-08. Passed 12-8-08.)
