739.03 PERMIT VALIDATION.
   No permit shall issue or remain valid, unless an applicant complies and continues to comply with the following provisions with the following permit limitations:
   (a)    Request to obtain a permit for operation is to be presented to the City Manager for approval no less than thirty days prior to the date on which entertainment shall commence, unless waived for good cause by the City Manager.
   (b)    If the location where the entertainment is to be held is separated from the nearest property zoned for residential use by a distance of at least 2,500 feet, the City Manager may grant a permit for a period of operation not to exceed ten consecutive days in any calendar year. For the purposes of this provision, no property owned by the City shall be deemed to be zoned for residential use.
   (c)    If the location where the entertainment is to be held is separated from the nearest property zoned for residential use by a distance of less than 2,500 feet, the City Manager may grant a permit for a period of operation not to exceed seven consecutive days.
   (d)    No permit for entertainment shall exceed ten consecutive days.
   (e)    When the entertainment is to be held on public property or when public property may be affected, as determined by the City Manager, the applicant shall post a performance bond or a certified check (as security for performance) of not less than three thousand dollars ($3,000) with the City to insure that the area used for and by such entertainment shall be cleaned and returned to its original condition after the close of such entertainment.
   (f)    Sanitary facilities as approved by the City Manager shall be provided by the applicant for the use of the public and employees.
   (g)    Security police in a number satisfactory to the Police Chief shall be provided by the applicant.
   (h)    Entertainment hours shall be from 10:00 a.m. until 11:00 p.m., Sunday through Thursday; 10:00 a.m. until 12:00 midnight, Friday and Saturday;   
   (i)    When the entertainment is to be held on public property or when public property may be affected, as determined by the City Manager, to protect the City from any and all liability filed against it, the applicant shall provide the City a certificate of insurance issued by a company licensed to do business within the State of Ohio, recognizing the City as an additional insured, in a total amount of not less than one million dollars ($1,000,000) for any personal injury and five hundred thousand dollars ($500,000) property damage caused as a result or consequence of entertainment having appeared within the City.
   (j)    A written statement attached by the Zoning Administrator and Fire Chief, respectfully, that the Zoning and Fire Codes have been or will be met;
   (k)    The fee for application/issuance of a permit shall be thirty-five dollars ($35.00) to be paid to the City Finance Director/designee.
