331.36 SQUEALING TIRES, "PEELING," CRACKING EXHAUST NOISES.
   (a)   No person in charge or control of any vehicle shall make, with such vehicle or any device connected therewith, any excessive noise to annoy the public, unnecessarily race his motor while running idle, open the muffler on any vehicle, or permit the vehicle or any device thereon to emit an unreasonable quantity of smoke or steam, noxious gases, or vapor upon the streets of the City.
   (b)   No person shall operate any motor vehicle, except when necessary for safe operation or in compliance with law, in such a manner that the vehicle is so rapidly accelerated or started from a stopped position that the exhaust system emits a loud, cracking, or chattering noise unusual to its normal operation, or the tires of the vehicle squeal or leave tire marks on the roadway, commonly called "peeling." (1978 Code 72.63)
   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
