(A) Prior to the establishment of an SDC, the City Council shall adopt a capital improvement plan, public facilities plan, master plan or comparable plan that includes a list of:
(1) The capital improvements that the city intends to fund in whole or in part with the improvement fee revenues; and
(2) The estimated cost and time of construction of each improvement and the percentage of that cost eligible to be funded with improvement fee revenues.
(B) In adopting this plan, the city may incorporate by reference all or a portion of any public facilities plan, master plan, capital improvements plan or similar plan that contains the information required by this section.
(C) The city may modify such plan and list at any time. If an SDC will be increased by a proposed modification to the list to include a capacity increasing public improvement the Council will:
(1) Order the methodology to be amended as necessary. Amendments to the methodology shall be made pursuant to § 34.10;
(2) Provide at least 30 days’ notice prior to adopting the modification to those who have requested notice pursuant to § 34.16; and
(3) Hold a public hearing if a written request for a hearing is received within seven days of the date of the proposed modification.
(D) A change in the amount of a reimbursement fee or an improvement fee is not a modification of the SDC if the change in amount is based on:
(1) A change in the cost of labor, materials or real property applied to projects or project capacity as set forth in the plan adopted pursuant to this section; and
(2) A periodic application of the ENR Construction Cost Index.
