§ 153.174 LOADING.
   (A)   Purpose. The purpose of this section is to provide adequate loading areas for commercial and industrial uses that do not interfere with the operation of adjacent streets and OR 42.
   (B)   Applicability. This section applies to new development and changes in use approved on or after February 3, 2012, where such uses are expected to have visits by service or delivery trucks on a regular basis.
   (C)   Standard. Planning Commission shall determine the need for off-street loading spaces, if any, based on information presented in the applicant’s site plan review application. At a minimum, when an off-street loading space is required, it shall be large enough to accommodate the largest vehicle that is expected to serve the use without obstructing vehicles or pedestrian traffic on adjacent streets and driveways. OR 42 shall not be obstructed and the Planning Commission may restrict the use of other public rights-of-way, so applicants are advised to provide complete and accurate information about the potential need for loading spaces.
   (D)   Placement, setbacks and landscaping. Loading areas shall conform to the commercial development standards of § 153.042 and the access and screening requirements of §§ 153.140 through 153.142 and 153.155 through 153.159. Where parking areas are prohibited between a building and the street, loading areas are also prohibited.
   (E)   Exceptions and adjustments. The Planning Commission may approve a loading area adjacent to or within a street right-of-way through site plan review only where it finds that loading and unloading operations are short in duration (i.e., less than one hour), infrequent, do not obstruct traffic during peak traffic hours, do not interfere with emergency response services and are acceptable to the applicable roadway authority (i.e., if different than the city).
