§ 52.26 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ACT. The federal Water Pollution Control Act, being 33 U.S.C. §§ 1251 et seq., also known as the Clean Water Act, as amended through the effective date of this subchapter.
   AUTHORIZED REPRESENTATIVE OF NONRESIDENTIAL USER. An authorized representative of a nonresidential user shall be:
      (1)   A principal executive officer of at least the level of vice president, if the nonresidential user is a corporation;
      (2)   A general partner or proprietor if the nonresidential user is a partnership or proprietorship, respectively; and
      (3)   An agent of the nonresidential user who is responsible for the overall operation of the facilities from which the discharge originates.
   BIOCHEMICAL OXYGEN DEMAND (BOD). The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20°C, expressed in milligrams per liter.
   CITY. The City of Myrtle Point.
   CITY MANAGER. The City Manager of the city as defined by the City Charter or by city ordinance, or the City Manager’s designee.
   CITY SEWERAGE SYSTEM. A treatment works as defined by § 212 of the Act. This definition includes any publicly owned sewers that convey wastewater, including conduits, pumps, treatment plants, structures and appurtenances used to transport, store or treat sewage, storm or surface water of any type.
   COOLING WATER. The water discharged from any use to which the only pollutant added is heat.
   DEQ. The State Department of Environmental Quality.
   DISCHARGE. The deposit of pollutants into the city sewerage system.
   EPA. The United States Environmental Protection Agency.
   INTERFERENCE. A discharge which, alone or in conjunction with a discharge or discharges from other sources, both:
      (1)   Inhibits or disrupts the POTW, its treatment processes or operations, or its sludge processes, use or disposal; and
      (2)   Therefore is a cause of a violation of any requirement of the POTW’s NPDES permit (including an increase in the magnitude or duration of a violation) or of the prevention of sewage sludge use or disposal in compliance with the following statutory provisions and regulations or permits issued thereunder (or more stringent state or local regulations): § 405 of the Clean Water Act; the Solid Waste Disposal Act (SWDA), being 42 U.S.C. §§ 6901 et seq. (including Title II, more commonly referred to as the Resource Conservation and Recovery Act (RCRA), being 42 U.S.C. §§ 6901 et seq., and including state regulations contained in any state sludge management plan prepared pursuant to subtitle D of the SWDA); the Clean Air Act, being 42 U.S.C. §§ 7401 et seq.; the Toxic Substances Control Act, being 15 U.S.C. §§ 2601 et seq.; and the Marine Protection, Research and Sanctuaries Act, being 16 U.S.C. §§ 1431 et seq. and 33 U.S.C. §§ 1401 et seq.
   MAY. The act referred to is permissive.
   NONRESIDENTIAL USER.
      (1)   All users of the city sewerage system which are not residential users (users of single and two-family dwellings). NONRESIDENTIAL USERS include public, commercial and industrial users identified in the Standard Industrial Classification Manual, 1972, Office of Management and Budget, as amended and supplemented, under the following divisions.

      (2)   A user in these Divisions may be excluded from the nonresidential user requirements of this subchapter if it is determined that it will introduce primarily domestic waste (wastewater emanating from dwellings) and waste from sanitary conveniences.
   PASS THROUGH. A discharge which exits the POTW into waters of the United States in quantities or concentrations which, alone or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any requirement of the POTW’s NPDES permit (including an increase in the magnitude or duration of a violation).
   PERSON. Any individual, partnership, joint venture, firm, company, cooperative, corporation, association, joint stock company, trust, estate, governmental entity or any other legal entity. The masculine gender shall include the feminine and the singular shall include the plural.
   pH. The logarithm (base 10) of the reciprocal of the hydrogen ion activity expressed in moles per liter of solution.
   POLLUTANT. Any element or compound discharged into the city sewerage system except water, unless the water has been heated or irradiated.
   POLLUTION. The alteration of the chemical, physical, biological or radiological state of water.
   PRETREATMENT. The reduction or elimination of pollutants in wastewater prior to discharging the wastewater into the city sewerage system.
   PRETREATMENT STANDARDS. Any regulation containing pollutant discharge limits promulgated by the EPA in accordance with § 307(b) and (c) of the Act, which applies to industrial users. This term includes prohibitive discharge limits established pursuant to 40 C.F.R. § 403.5.
   RESTRICTED SUBSTANCE. Pollutants which may be discharged into the city sewerage system only as prescribed by the City Manager pursuant to § 52.28.
   SHALL. The act referred to is mandatory.
   SIC NUMBER. A classification pursuant to the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget, 1972, as amended and supplemented through the effective date of this subchapter.
   SLUG LOAD. Any discharge of a non-routine, episodic nature, including, but not limited to, an accidental spill or a non-customary batch discharge, which has a reasonable potential to cause interference or pass through, or in any other way violate the POTW’s regulations, local limits or permit conditions. The results of such activities shall be available to the approval authority upon request. significant industrial users are required to notify the POTW immediately of any changes at its facility affecting potential for a slug discharge.
   STATE. The State of Oregon.
   SUSPENDED SOLIDS or TOTAL SUSPENDED SOLIDS (TSS). The total elements and compounds which float on the surface of, or are suspended in, wastewater and which are removable by laboratory filtration.
   TOXIC POLLUTANT. Any pollutant or combination of pollutants identified pursuant to § 307(a) of the Act or otherwise listed as toxic in regulations previously promulgated by the EPA, or as identified by the City Manager.
   WASTEWATER. Liquid or water-carried pollutants including any groundwater, surface water and stormwater that may be present, whether treated or untreated, which is discharged, flows or infiltrates into the city sewerage system.
   WASTEWATER DISCHARGE PERMIT. A permit issued pursuant to § 52.32.
