§ 52.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BIOCHEMICAL OXYGEN DEMAND (BOD). The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20°C, expressed in milligrams per liter.
   BUILDING DRAIN. The part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet (one and one-half meters) outside the inner face of the building wall.
   BUILDING SEWER. The extension from the building drain to the public sewer or other place of disposal.
   CITY. The City of Myrtle Point.
   CITY MANAGER. The City Manager of the City of Myrtle Point, as defined by the City Charter or ordinance, or the City Manager’s designate.
   COMBINED SEWER. A sewer that is designed as a sanitary sewer and a storm sewer.
   CONNECTION CHARGE. The charge made by the city for connecting to the public sewage works. It is to be differentiated from user charges, permit fees and inspection fees.
   GARBAGE. Solid wastes from the domestic and commercial preparation, cooking and dispensing of food, and from the handling, storage and sale of produce.
   INDUSTRIAL WASTES. The liquid wastes from industrial manufacturing processes, trade or business as distinct from sanitary sewage.
   MAY. The act referred to is permissive.
   NATURAL OUTLET. Any outlet into a watercourse, pond, ditch, lake or other body of surface or groundwater.
   OPERATION AND MAINTENANCE. Activities required to ensure the dependable and economical function of sewage works.
      (1)   MAINTENANCE. Preservation of functional integrity and efficiency of equipment and structures. This includes preventive maintenance, corrective maintenance and replacement of equipment.
      (2)   OPERATION. Control of the unit processes and equipment that make up the sewage works. This includes keeping financial and other management records, laboratory control, process control, safety and emergency operation planning, employment of attorneys and consultants, payment of court costs and payment of any costs or fees reasonably associated with any of the above.
   PERSON. Any individual, partnership, joint-venture, firm, company, cooperative, corporation, association, joint stock company, trust, estate, governmental entity or any other legal entity. The masculine gender shall include the feminine and the singular shall include the plural.
   pH. The logarithm (base 10) of the reciprocal of the hydrogen ion activity expressed in moles per liter of solution.
   PROPERLY SHREDDED GARBAGE. The wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch (1.27 centimeters) in any dimension.
   PUBLIC SEWER. A sewer in which all owners of abutting properties have equal rights, and which is controlled by public authority.
   PUBLIC WORKS DIRECTOR. The Public Works Director of the City of Myrtle Point, or his or her designate.
   REPLACEMENT. Obtaining and installing equipment, accessories or appurtenances that are necessary during the design or useful life, whichever is longer, of the sewage works to maintain the capacity and performance for which such works were designed and constructed.
   SANITARY SEWER. A conduit intended to carry liquid and water-carried wastes from residences, commercial buildings, industrial plants and institutions together with minor quantities of ground, storm and surface waters that are not intentionally admitted.
   SEWAGE. A combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground, surface and stormwaters as may be present. The term SEWAGE means wastewater.
   SEWAGE TREATMENT PLANT (STP). Any arrangement of devices and structures used for treating sewage.
   SEWAGE WORKS. All facilities for collecting, pumping, treating and disposing of sewage.
   SEWER. A pipe or conduit for carrying sewage.
   SHALL. The act referred to is mandatory.
   SLUG. Any discharge of water, sewage or industrial waste which in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than 15 minutes more than five times the average 24-hour concentration or flows during normal operation.
   STORM SEWER (STORM DRAIN). A sewer designed to carry only stormwaters, surface run-off, street wash waters and drainage.
   SUSPENDED SOLIDS. Solids that either float on the surface of, or are in suspension in, water, sewage or other liquids and which are removable by laboratory filtering.
   USER. Every person using any part of the public sewage works of the city.
   USER CHARGE. The charge levied on all users of the public sewage works. USER CHARGES shall, at a minimum, cover each user’s proportionate share of the cost of operation and maintenance (including replacement) of the public sewage works.
   WATERCOURSE. A channel in which a flow of water occurs, either continuously or intermittently.
