§ 153.288 VARIANCE.
   A zoning variance is a modification of the literal provisions of this chapter granted when strict enforcement would cause undue hardship due to circumstances unique to the individual property on which the variance is granted. The crucial points of variance are undue hardship, and unique circumstances applied to property. A variance is not justified unless all of these elements are present in the case.
