§ 94.99 PENALTY.
   (A)    Whenever any person is alleged to have violated any of the provisions of this chapter, he or she may execute a waiver of appearance and enter a plea of guilty by signing, completing, and complying with the cited item or items on a waiver form provided by the governing body of the municipality. At the time of such waiver and plea of guilty, he or she must pay the fine hereinafter set forth for the violation or violations charged, in order to avail himself or herself of the benefits herein provided. For each violation charged, the following citation fees apply:
      (1)   First violation - $50 plus $25 per day confinement fee;
      (2)   Second violation - $75 plus $25 per day confinement fee;
      (3)   Third violation - $100 plus $25 per day confinement fee;
      (4)   Add $25 for each subsequent violation plus $25 per day confinement fee.
   (B)   At the time of the commission of the alleged violation, the accused may be served with a printed notice allowing him or her to avail himself or herself of the provisions of this section with the period of time before the date specified thereon. and in the event that he or she chooses not to avail himself or herself of the benefits hereof, he or she shall be prosecuted for violation of a misdemeanor, and assessed a fine in accordance with the schedule as set forth in the section, and the court costs.
   (C)   The Municipal Clerk shall retain as part of his or her records the copy of the notice given to the violator and presented at the time the benefits of this section are accepted, and he or she shall from said notices prepare a report showing the number of the notice, the name of the violator, the date of the offense and the amount of the fine collected by him or her. All fines shall be paid to the Municipal Clerk and posted to the General Fund for administrative purposes. All citations and applicable assessed fees shall be paid by cash, money order, cashier check, or credit card prior to the release of any dog or cat that was impounded.
