§ 94.58 IMPOUNDING; NOTICE.
   (A)    The Code Enforcement Officer, Humane Office, or any person designated by the governing body as an animal control enforcement officer shall capture and secure any animal in violation of any provision of this chapter and convey the animal to the place of impoundment so designated by the governing body. The animals so impounded shall be treated in a humane manner and shall be provided with a sufficient supply of food and fresh water each day. Each impounded animal shall be kept and maintained at an animal shelter for a period of not less than five days after public notice has been given unless reclaimed earlier by the owner. Public impoundment notice may include:
      (1)   Significant marks or identifications;
      (2)   Breed, color, sex, or age if possible;
      (3)   Posting within 48 hours at three public places;
      (4)   Place of confinement identified;
      (5)   Contact authority.
   (B)   Any dog or cat may be reclaimed by the owner during regular business hours of the clerk's office upon paying all associated costs incurred by the municipality including but not limited to confinement fees, enforcement fees, citation costs, and licensing fees prior to the release of the dog or cat to the owner. The owner shall be required to provide proof of rabies vaccination within 72 hours after release. If the dog or cat is not claimed at the end of the five days after public notice has been given, the Code Enforcement Officer, Humane Office, or any person designated by the governing body as animal control enforcement officer may dispose of the animal in accordance with the applicable rules and regulations pertaining to the same; provided, that if, in the judgment of the Code Enforcement Officer, Humane Office, or any person designated by the governing body as animal control enforcement officer, a suitable home can be found for an such animal, then said animal shall be turned over to that person and the new owner shall then be required to pay all fees by cash, money order, cashier check, or credit card and meet all licensing and vaccinating requirements provided in the chapter. The municipality shall acquire a legal title to any unlicensed animal captured within the municipality jurisdiction and impounded at the shelter for a period longer than five days after giving notice. All animals shall be destroyed and buried in a humane manner as prescribed by the Board of Health unless a suitable home can be found for such animal. or if a suitable animal shelter will accept transfer and possession of the animal.
