(A) Rates for mitigation charges. The town Volunteer Fire Department shall establish rates for mitigation changes for personnel, supplies and equipment for its delivery of fire protection services and rescue services. The mitigation charges shall be based upon the actual cost of services, equipment, and supplies; and shall be approved by the Board of Commissioners of the town.
(B) Claims. The town shall file a claim for the mitigation charges against the responsible party or parties only in connection with motor vehicle crashes and in connection with residential fires which are the result of a criminal act.
