(A) Notification of name of organization, group, or individual soliciting contributions. An organization, group, or individual soliciting contributions from the operators and/or occupants of motor vehicles being operated on the streets or highways within the corporate limits of the Town of Murphy shall notify the operators and/or occupants of the motor vehicles of the name and address of the organization, group, or individual soliciting contributions by posting signs containing the name and address of the organization, group, or individual soliciting contributions printed in letter and numerals at least five inches in height. The signs shall be posted at the location at which the organization, group, or individual is soliciting contributions and shall be clearly visible to the operators and/or occupants of motor vehicles being operated on the public streets or highways of the Town of Murphy at the location.
(B) Application to solicit.
(1) Each organization, group, or individual proposing to solicit contributions from the operators and/or occupants of motor vehicles being operated on the public streets of the Town of Murphy for any charitable or eleemosynary purpose shall file an application to solicit with the Chief of Police of the Town of Murphy on a form to be provided for that purpose, including the following information:
(a) The name, address, and telephone number of the organization, group, or individual desiring to solicit contributions;
(b) The name, address, and telephone number of the person filing the application;
(c) The name, address, and telephone number of the person who will be present at, in charge of, and responsible for the solicitation;
(d) The nature of the charitable or eleemosynary purpose of the organization, group, or individual desiring to solicit contributions;
(e) Credentials showing the relationship of the person making the application to the organization or group desiring to solicit contributions;
(f) The date and exact time of day during which the organization, group, or individual proposes to solicit contributions; and
(g) The specific location within the Town of Murphy at which the organization, group, or individual purposes to solicit contributions.
(2) The Chief of Police of the Town of Murphy shall review and approve or deny each applications to solicit contributions giving due regard to the date, time of day, and location for the solicitation, other events or activities scheduled or occurring within the corporate limits of the Town of Murphy affecting vehicular and/or pedestrian traffic within the Town of Murphy, and public safety.
(3) No organization, group, or individual shall solicit contributions from the operators and/or occupants of motor vehicles being operated on the public streets or highways within the corporate limits or the Town or Murphy, unless the Chief of Police of the Town of Murphy has approved the application of the organization, group, or individual to do so.
(C) Enforcement. It shall be the duty of the Police Department of the Town of Murphy to enforce the provisions of this section.
(D) Exercise of police power. This entire section shall be deemed and construed to be an exercise of the police power of the Town of Murphy for the preservation and protection of public safety, and all of its provisions shall be liberally construed with a view of the effectuation of the purpose.
