§ 55.02 RECEPTACLES REQUIRED.
   (A)   It shall be the duty of the owner, lessee, or occupant of every residence, house, restaurant, hotel, hospital, business building, manufacturing plant, and other buildings of every type and kind to provide and keep on the premises upon which the buildings are situated, as many receptacles as may be necessary for the purpose of receiving and holding garbage, refuse, and ashes and shall deposit in the receptacles all garbage, refuse, and ashes as same accumulate.
   (B)   The receptacles shall not have less than ten-gallon capacity or more than 32-gallon capacity except dumpster receptacles which are unloaded by a mechanical device attached to truck or other vehicle used for the purpose of picking up the garbage, refuse, and ashes.
   (C)   The receptacles shall be constructed, maintained and covered so as to prevent the entrance of flies, rodents, cats, dogs, or other animals or insects.
   (D)   The receptacles shall be provided with close-fitting covers and handles.
   (E)   The receptacles shall be maintained and kept water-tight by the owner or person having the custody or control of the receptacles, and any leaking container shall be subject to removal by the collectors.
   (F)   No ashes shall be placed in receptacles until ashes have been sprayed thoroughly with water and completely cooled so that there is no danger of any combustion or fire being caused or produced therefrom and in addition to the other penalties is herein provided by this chapter the owner or person having in their charge and custody the receptacles shall be liable to the Town of Murphy for all damages caused by fire or combustion in the event of failure to comply with this provision of the chapter.
