§ 54.27 EXISTING BUILDING SEWER CONNECTIONS PRIOR TO APPLICABLE DATE OF THIS CHAPTER.
   (A)   Any person, owner, or concern using a sewer connection or connections prior to and at the date of enactment of this chapter may be required by the appropriate authority to maintain effect repairs, make replacement or otherwise place any private sewer system lying on property owned or controlled by the person, owner, or concern in good working order free of:
      (1)   Leaks which allow ground water to enter the sewer;
      (2)   Leaks which allow sewage or other waste to enter the soil;
      (3)   Leaks which permit storm water or rain to enter the sewer; and/or
      (4)   Roof drains or storm drains discharging to the sewer.
   (B)   The sewer system including private sewers to existing building sewer connections may be tested from time to time to reveal the sources of leakage on detection of a leak or leaks considered by the appropriate authority to be of importance in any of the categories in this section; the appropriate authority shall inform the person, owner, or concern repair or replace the sewer in accordance with the general requirements of §§ 54.40 et seq.; the repairs shall be effected to the satisfaction of the appropriate authority within 60 days of the date of notification. Failure to comply shall incur a penalty in an amount determined from time to time by the Board of Commissioners per month or part thereof until the required repairs are made.
