(A) All food processing facilities and all food handling facilities which process, cook, and/or serve food to the public or persons entrusted in their care, including, but not limited to, restaurants, fast-food establishments, and school cafeterias, which are connected to the sewer system of the Town of Murphy shall install a greasetrap of sufficient size to prevent the introduction of grease and/or oils into the sewer system of the Town of Murphy and shall pump or empty the greasetrap as regularly as necessary so as to prevent the introduction of grease and/or oils into the sewer system of the Town of Murphy.
(B) The greasetrap of any food processing facility or food handling facility which is connected to the sewer system of the Town of Murphy shall be subject to periodic inspection by the Director of the Town of Murphy Wastewater Treatment Plant or his or her authorized assistants and by the inspectors of the Cherokee County Health Department for the determination of the character, use, and effectiveness of the greasetrap as often as may be deemed necessary by the Director of the Town of Murphy Wastewater Treatment Plant and/or the inspectors of the Cherokee County Health Department.
(C) A surcharge shall be added to the monthly bill of each food processing facility or food handing facility which is connected to the sewer system of the Town of Murphy for so long as the food processing facility or food handling facility does not have installed and in use a greasetrap as required by the provisions of this section. The surcharge shall be in relation to the sewer flow of the particular facility. Any food processing facility or food handling facility which is billed for less than 25,000 gallons of water on its monthly water bill from the Town of Murphy shall be surcharged a fee as determined from time to time by the Board of Commissioners. Any food processing facility or food handling facility which is billed for 25,000 gallons of water or more on its monthly water bill from the Town of Murphy shall be surcharged a fee as determined from time to time by the Board of Commissioners plus an additional amount as determined from time to time by the Board of Commisioners per 1,000 gallons of water for all water for which the food processing facility or food handling facility is billed in excess of 25,000 gallons of water on its monthly water bill from the Town of Murphy.
(D) Upon the failure of any food processing facility or food handling facility which is connected to the sewer system of the Town of Murphy to have installed a greasetrap of sufficient size to prevent the introduction of grease and/or oils into the sewer system into the Town of Murphy or to pump or empty the greasetrap as regularly as necessary so as to prevent the introduction of grease and/or oils into the sewer system of the Town of Murphy as required by this section, as documented by the Director of the Town of Murphy Wastewater Treatment Plant or his or her authorized assistants or by the inspectors of the Cherokee County Health Department, the food processing facility or food handling facility shall be notified in writing of its failure to comply with the provisions of this section. Upon the failure of the food processing facility or food handling facility to comply with the provisions of this section within ten days after receipt of written notification of its failure to comply with the provisions of this section, water service from the Town of Murphy to the food processing facility or the food handling facility shall be terminated and shall remain terminated until the time as the food processing facility or food handling facility complies with the provision of this section. Upon the failure of any food processing facility or food handling facility which is connected to the sewer system of the Town of Murphy to permit inspection of its greasetrap by the Director of the Town of Murphy Wastewater Treatment Plant or his or her authorized assistants, or the inspectors of the Cherokee County Health Department, water service from the Town of Murphy to the food processing facility or the food handling facility shall be immediately terminated and shall remain terminated until the time as the food processing facility or food handling facility permits inspection of its greasetrap.
