909.01 OPENING AND USE OF CITY STREETS.
   (a)   Prior to the opening and use of the dedicated streets, roads and thoroughfares within the Municipality, and prior to the Municipality maintaining such streets, roads, and thoroughfares, it shall be necessary for the property owner to comply with the following rules and regulations established herein:
      (1)   The street, road or thoroughfare must be graded to a reasonable grade and cross section as approved by the Engineer and as placed on file with the Municipality.
      (2)   The owner shall furnish and install under the direction, supervision, and control of the City Engineer, the required improvements consistent with and at least equal to the requirements described in Section 1181.05. The City Engineer shall provide the standards and specifications required by Section 1181.05 and the Planning Commission shall not be involved in the opening and use of streets and roads that have already been dedicated for public use. In addition, the Planning Commission may waive the construction or installations of sidewalks, monuments and street lighting if, in the Engineer’s opinion due to special circumstances, conditions, or other reasons, the public health, safety and welfare are not jeopardized.
      (3)   In the event top soil exists on the street, road or thoroughfare to be opened, the owner shall remove all top soil to a suitable foundation before grading.
   (b)   All of the installation, excavating and materials to be furnished shall be subject to the approval of the Engineer.
      (1)   All charges incurred by the Municipality for services of the Engineer shall be paid by the property owners.
      (2)   The property owner shall deposit with the City Clerk-Treasurer an amount sufficient to pay the cost of engineering services, as estimated by the Engineer, before any engineering services shall be performed by the Engineer.
   (c)   At the completion of the work to be performed by the owner as hereinabove set forth which such work shall be done under the direction, supervision and control of the Engineer, the Municipality will then furnish and place the required drainage culverts under street intersections and the Municipality shall make the required adjustments in manholes and valve boxes and shall install street signs.
   (d)   After the work has been performed by the property owner and such work is performed to the satisfaction of the Engineer, then in that event, the Municipality shall provide future maintenance of such roads, streets and thoroughfares.
