105.01 BIDDING REQUIREMENTS.
   (a)   (1)   The Mayor may enter into a contract for the purchase of emergency supplies, materials, services, insurance and/or labor involving less than fifty thousand dollars ($50,000) during a calendar year without the necessity of competitive bidding upon written approval from the President of Council and/or the Vice President of Council in the absence of the President.
      (2)   The Mayor may enter into a contract to purchase supplies, materials, services, insurance, and/or labor involving not more than twenty-five thousand dollars ($25,000) during a calendar year without written approval from Council or the necessity of competitive bidding.
   (b)   Unless Council finds the required materials, labor, service or insurance is of a specialized nature as not to lend itself to competitive bidding and/or an emergency exists, contracts exceeding fifty thousand dollars ($50,000.00) in a calendar year, shall be with the lowest and most responsible bidder after advertisement for not less than two nor more than four weeks in a newspaper of general circulation within the City. However, contracts entered into pursuant to Ohio R.C. 713.23(D), 125.04 or 5513.01, or with another political subdivision or instrumentality of the State, or available from a qualified nonprofit agency pursuant to Ohio R.C. 4115.31 through 4115.35 are exempt from competitive bidding.
   (c)   Upon findings by the Council of the City of Munroe Falls that real estate is not needed for public use, the real estate may be sold or leased upon either of the following procedures:
      (1)   The real property shall be advertised for sale or lease once a week for three consecutive weeks in a newspaper of general circulation within the City of Munroe Falls and shall be conveyed to the highest bidder upon approval by the majority of the Council of the City of Munroe Falls.
      (2)   Without advertising a sale or lease of the real property may be made to a named grantee at a fixed price and/or term when the Council of the City of Munroe Falls specifically authorizes said sale or lease by a two-thirds vote of its members.
