§ 38.04 PROCEDURES.
   The following grievance procedures are set forth for any person who believes that he or she has been subjected to discrimination based on handicapped status as prohibited by the Federal Revenue Sharing program regulations and Section 504 of the Rehabilitation Act of 1973.
   The purpose of the procedures is to assure the prompt and equitable resolution of complaints alleging such discrimination. These procedures do not apply to discrimination in employment. Such complaints should be presented under procedures set forth in the personnel policies and procedures.
   (A)   Step one. Any person with a grievance concerning handicapped access to programs, services, and benefits that the city provides shall present the grievance, in writing, to the City Clerk. The City Clerk shall attempt to correct the matter immediately, if possible, or provide a written response within five days specifying the action to be taken and the deadline for such action.
   (B)   Step two. If the complainant is not satisfied with the response of the City Clerk, or if no action is taken, the written grievance shall be submitted to the Mayor. The Mayor shall meet with the complainant or his representative to discuss the problem informally. Documentation of this meeting shall be prepared and maintained in the local government's files. The Mayor shall provide a written response within 15 days of the informal meeting concerning the action to be taken and the deadline for completion.
   (C)   Step three. If the Mayor's response is not satisfactory, or if no action is taken, the complainant may take the grievance to the City Council. A hearing may be requested by submitting the written request to the Mayor. The grievance shall be brought before the City Council no later than the next regular scheduled meeting. A special meeting of the City Council may be called if necessary, to discuss the grievance.
   (D)   Discussion. In discussing the grievance, the complainant may designate any person of his choice to appear with him and participate in the discussion. Written documentation of the discussion shall be maintained in the city records.
   (E)   Written decision. The City Council shall issue a written decision on the matter within 15 days. This decision shall be the final procedure for the complainant at the local level.
