(A) A Utilities Superintendent shall be appointed in the event that there is more than one municipal utility and the governing body determines that it is in the best interest of the municipality to appoint one official to have the immediate control over all said municipal utilities and municipal streets. The Utilities Superintendent may be removed at any time by a two-thirds vote of the governing body. Any vacancy occurring in said office by death, resignation or removal may be filled in the manner hereinbefore provided for the appointment of all municipal officials.
(B) The Utilities Superintendent’s duties over the following departments shall be as stated herein.
(1) Water Department.
(a) The Utilities Superintendent shall have general supervision and control over the municipal water system and shall be primarily responsible for its economic operation and prudent management. Included in said water system shall be the water plan, the pump house and all machinery and appliances used in connection with producing and distributing water to inhabitants of the municipality. All actions, decisions and procedures of the Superintendent shall be subject to the general directives and control of the governing body.
(b) The Utilities Superintendents shall have the general control and supervisory authority over all employees of the water system which the governing body may from time to time hire to operate and maintain said system. Unless some other official is specifically designated, he or she shall collect all money received by the municipality on account of said system of water works and shall faithfully account for and pay over to the Municipal Clerk-Treasurer all such money collected in the name of the municipality and receive a receipt from the Municipal Clerk-Treasurer for the depository evidence of his or her faithful discharge of this duty. This receipt shall be kept by the Utilities Superintendent. He or she shall make a detailed report to the governing body at least once every six months of the condition of said water system of all mains, pipes, hydrants, reservoirs and machinery, and such improvements, repairs and extension thereof as he or she may think proper. This report shall show the amount of receipts and expenditures on account thereof for the preceding six months. No money shall be expended for improvements, repairs or extensions of said waterworks system, except upon the recommendation of the Utilities Superintendent.
(2) Sewer Department.
(a) The Utilities Superintendent shall have general supervision and control over the municipal sewer system and shall be primarily responsible for its economic operation and prudent management. Included in said sewer collection system shall be all machinery and appliances used in connection with providing sewage disposal to inhabitants of the municipality. All actions, decisions and procedures of the Superintendent shall be subject to the general directives and control of the governing body. He or she shall have the general control and supervisory authority over all employees of the sewer system which the governing body may from time to time hire to operate and maintain said system.
(b) Unless some other official is specifically designated, the Utilities Superintendent shall collect all money received by the municipality on account of said system of sewer works and shall faithfully account for and pay over to the Municipal Clerk-Treasurer all such money collected in the name of the municipality and receive a receipt from the Municipal Clerk-Treasurer for the depository evidence of his or her faithful discharge of this duty. This receipt shall be kept by the Superintendent. He or she shall make a detailed report to the governing body at least once every six months of the condition of said sewer system of all mains, pipes, machinery and such improvements, repairs and extension thereof as he or she may think proper. This report shall show the amount of receipts and expenditures on account thereof for the preceding six months. No money shall be expended for improvements, repairs or extensions of said sewer system except upon the recommendation of the Utilities Superintendent. He or she shall perform such additional duties as may be prescribed by the governing body.
(3) Electrical Department.
(a) The Utilities Superintendent shall have general supervision and control over the municipal electrical system and shall be primarily responsible for its economic operation and prudent management. Included in said electrical system shall be the electrical plant, the electricity distribution system and all machinery and appliances used in connection with producing and distributing electricity to inhabitants of the municipality. All actions, decisions and procedures of the Utilities Superintendent shall be subject to the general directives and control of the governing body.
(b) The Utilities Superintendent shall have the general control and supervisory authority over all employees of the electric system which the governing body may from time to time hire to operate and maintain said system. Unless some other official is specifically designated, he or she shall collect all money received by the municipality on account of said system of electric works, and shall faithfully account of said system of electric works, and shall faithfully account and pay over to the Municipal Clerk-Treasurer all such money collected in the name of the municipality and receive a receipt from the Municipal Clerk-Treasurer for the depository evidence of his or her faithful discharge of this duty. This receipt shall be kept by the Superintendent. He or she shall make a detailed report to the governing body at least once every six months of the condition of said electric system of all lines, poles, electric generation equipment and machinery and such improvements, repairs and extensions thereof as he or she may think proper. This report shall show the amount of receipts and expenditures on account thereof for the preceding six months. No money shall be expended for improvements, repairs or extensions of said electric system except upon the recommendation of the Utilities Superintendent. He or she shall perform such additional duties as may be prescribed by the governing body.
(4) Street Department.
(a) The Utilities Superintendent shall have general supervision and control over the municipal street system and shall be primarily responsible for its economic operation and prudent management. Included in said street system shall be all the streets and alleys within the municipality, with the exception of responsibilities for certain streets which may be part of the State Department of Roads highway system, and all machinery and appliances used in connection with the operation and maintenance of the street system for use by inhabitants of the municipality. All actions, decisions and procedures of the Superintendent shall be subject to the general directives and control of the governing body.
(b) The Utilities Superintendent shall have the general control and supervisory authority over all employees of the street system which the governing body may from time to time hire to operate and maintain said system. Unless some other official is specifically designated, he or she shall collect all money received by the municipality on account of said system of streets and shall faithfully account for and pay over to the Municipal Clerk-Treasurer all such money collected in the name of the municipality and receive a receipt from the Municipal Clerk-Treasurer for the depository evidence of his or her faithful discharge of this duty. This receipt shall be kept by the Utilities Superintendent. He or she shall make a detailed report to the governing body at least once every six months of the condition of said street system of all streets and alleys and machinery and such improvements, repairs and extensions thereof a he or she may think proper. He or she shall perform such additional duties as may be prescribed by the governing body.
(5) Municipal Solid Waste Management Department.
(a) The Utilities Superintendent shall have general supervision and control over the municipal solid waste management system and shall be primarily responsible for its economic operation and prudent management. Included in said Municipal Solid Waste Management Department shall be the municipal solid waste management program for the municipality. All actions, decisions and procedures of the Superintendent shall be subject to the general directives and control of the governing body.
(b) The Utilities Superintendent shall have the general control and supervisory authority over all employees of the municipal solid waste management system which the governing body may from time to time hire to operate and maintain said system. Unless some other official is specifically designated, he or she shall collect all money received by the municipality on account of said municipal solid waste management system and shall faithfully account for and pay over to the Municipal Clerk-Treasurer all such money collected in the name of the municipality and receive a receipt from the Municipal Clerk-Treasurer for the depository evidence of his or her faithful discharge of this duty.
