§ 31.24 COMMISSIONERS.
   (A)   At the first meeting of the Town Council in each calendar year, members of the Town Council shall be elected by majority vote of the Town Council to each of the following positions:
      (1)   Street Commissioner;
      (2)   Water and Sewer Utility Commissioner;
      (3)   Police Commissioner; and
      (4)   Parks Commissioner.
   (B)   Commissioners of particular departments shall have no independent authority or jurisdiction to act within the department to which he or she is assigned, except as specifically authorized by law or by other ordinance, but the commissioner shall review, oversee and report on the activities of his or her department, as the Town Council may direct. A member of the Town Council may serve as a commissioner in not more than two positions.
   (C)   The terms of the appointments of the commissioners hereinabove provided shall be for one year, commencing on the date of appointment and terminating on the first Tuesday in January of the following calendar year (or upon the appointment and qualification of a successor) unless the term is terminated upon a majority vote of the Council. In the event that any Council member fails to agree to fill a commission, then the President of the Town Council shall appoint a commissioner to fulfill the duties of the commissioner until the position is filled by election by the Town Council.
