§ 153.07 PERMIT AND BOND.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      COUNCIL. The Town Council.
      PUBLIC STORMWATER SYSTEM. Stormwater management pipes and structures paid for with public funds and located within rights of way or easements of the town.
      TOWN. The Town of Mulberry, Indiana.
   (B)   Stormwater connection permits.
      (1)   No person shall discharge directly or indirectly into the public stormwater system without the town having had issued a stormwater connection permit for the real estate and without the real estate having actually been connected to the town’s public stormwater system in accordance with the limitations noted on the stormwater connection permit, which may include, but not be limited to, an expiration date, a mandatory open ditch inspection and the dedication of public sewer mains to be used, and compliance with other terms, conditions and rules of the town, unless the Council has authorized otherwise.
      (2)   A stormwater connection permit issued for the real estate shall be valid for one year from the date of its issuance in order for the user to make an approved physical connection to the public stormwater system.
      (3)   A fee of $50 shall be paid to the town before the issuance of a stormwater connection permit. Said fee shall be received as revenue of the Stormwater Fund in the town’s sewage utility. If a permit has been cancelled, rescinded or terminated, a fee of $150 shall be paid to the town before such permit may be reinstated.
      (4)   A performance bond in the minimum penal amount of $15,000, issued by a corporate surety authorized to do business in the state, shall be furnished in advance of performing any work under a stormwater connection permit.
      (5)   The form of the permit and bond required under this section shall be prescribed or approved by the Council. The Council may delegate administration of this section to one or more officers or employees of the town.
