(A) Authority. This section is adopted pursuant to the authority conferred in I.C. 31-37-3-4.

(B) Normal town curfew hours. Except as otherwise provided in this section, the normal hours of curfew for children 17 years of age or younger in the town are after 11:00 p.m. and before 5:00 a.m. on any day.

(C) Advanced town curfew hours.
(1) During all applicable periods provided in division (D) below, curfew for a child 15, 16 or 17 years of age in the town shall be:
(a) After 11:00 p.m. Friday and before 5:00 a.m. Saturday;
(b) After 11:00 p.m. Saturday and before 5:00 a.m. Sunday;
(c) After 9:00 p.m. on Sunday, Monday, Tuesday, Wednesday and Thursday; and
(d) Before 5:00 a.m. on Monday, Tuesday, Wednesday, Thursday and Friday.
(2) During all applicable periods provided in division (D) below, curfew for a child under the age of 15 shall be between the hours of 9:00 p.m. each evening and 5:00 a.m. the next morning.

(D) Applicable periods of advanced town curfew times. The advanced curfew times established in division (C) above shall be in effect at all times, unless superseded by order of the Town Council.

(E) Defenses. All defenses to curfew violation provided in I.C. 31-37-3-3.5, and all statutes amendatory thereto and in replacement thereof, shall be available to children found in violation of this section.
