§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter shall be subject to the schedule of fees of the Town Council, to be accessed in the Ordinance Violations Bureau, or, if the aforementioned fee schedule is not applicable, § 10.99 of this code of ordinances. In lieu of appearing before a court of competent jurisdiction, the person so charged may pay the fine assessed within 14 days to the Town Ordinance Violations Bureau. Upon conviction of a third or subsequent offense committed within one year after the date of the first offense, the penalty shall be a fine of not more than $1,000. In addition to the fines provided herein, an animal in violation of this chapter may be impounded at the owner’s expense until the penalty and all court costs are paid.
   (B)   For each violation of § 90.06(B), a civil penalty shall be imposed as follows:
      (1)   Fifty dollars for the first violation;
      (2)   One hundred dollars for the second violation; and
      (3)   A penalty not to exceed $500 for each subsequent violation, in addition to which the animal may be impounded at the owner’s expense until the penalty and any court costs are paid.
